Welcome to Pamela Mary Music • Agape Media: Reel Creative • AI You Videos (“we,” “us,” “our”). By visiting our websites or working with us (including free calls, proposals, and paid projects), you agree to these Terms.

1) Who we are

We create AI-powered spokesperson/character videos and related creative services (e.g., scripting, editing, strategy). Our sites include: pamelamarymusic.com and any pages we operate for Agape Media: Reel Creative / AI You Videos.

2) Age & eligibility

You must be 18+ and able to enter a binding contract.

3) Booking, proposals & payments

  • Discovery/Consultation/Preview Calls: Free 20-minute calls are for scoping only; they are not creative workshops or training.

  • Estimates & scope: Written proposals describe deliverables, timeline, price, and what’s included (e.g., number of video variants, length, revision rounds). Work outside scope is billed at our then-current rates with your approval.

  • Payment: We use third-party processors (e.g., Venmo, PayPal,Stripe). Invoices are due upon receipt unless stated otherwise. Work begins after required payment(s) clear.

4) AI video specifics (very important)

  • Likeness & rights: You represent and warrant that you own—or have written permission to use—any likeness, image, brand assets, characters, or voices you ask us to clone or recreate. You agree not to request deceptive “deepfakes” or unlawful impersonations.

  • Voice cloning: Not included by default. Any voice work beyond standard AI options is a separate add-on.

  • Quality & tools: We choose the production tools needed to deliver the agreed result. Because AI evolves quickly, minor visual/voice variations are normal.

  • Use limitations: You’ll use the videos lawfully and in line with platform policies and advertising rules. No hate, harassment, illegal claims, or misleading endorsements.

5) Revisions & approvals

Unless your proposal states otherwise, your package includes 1 revision round for script and 1 round for the final cut. Revisions are for tweaks, not new concepts. Approval of a stage (e.g., script) moves us to the next step; changes after approval may require additional fees.

6) Delivery & timeline

We aim for fast delivery (often within ~48 hours for first drafts), but timing can shift based on your responsiveness, complexity, and tool queues. We’ll communicate updates promptly.

7) Refunds & cancellations

Choose the option that matches your policy (pick one and delete the others):

Option A (Flexible): If you’re not happy with the first draft, notify us within 7 days and before final delivery; we’ll either revise or refund your project fee minus any non-recoverable costs (e.g., paid assets). No refunds after final delivery.
Option B (Credit): Refunds are not offered; if you’re unhappy with the first draft, we’ll provide reasonable revisions or a credit toward a future project.

Note: Any third-party ad spend, platforms, or software costs are non-refundable.

8) Intellectual property & usage rights

  • Your stuff: You keep ownership of the assets you supply (logos, photos, character IP, etc.). You grant us a limited license to use them to complete the project.

  • Our stuff: We retain ownership of production files, prompts, project files, templates, and processes unless your agreement assigns them.

  • Final deliverables: Upon full payment, you are granted a license to use the final rendered videos for the agreed purposes (e.g., organic social, ads, website) and term. If you need broader usage (platforms, regions, exclusivity), tell us upfront—fees may apply.

  • Portfolio: We may display non-confidential work in our portfolio and socials. If you need a blackout (e.g., stealth launch), tell us in writing before we start.

9) Acceptable use

You agree not to use our services or deliverables for illegal activity, deception, harassment, medical/financial/legal claims without substantiation, or content that violates platform rules. We may decline or terminate projects that conflict with laws, ethics, or our brand standards.

10) Disclaimers

We provide creative services, not legal, medical, or financial advice. Results vary. Engagement, sales, and ad performance depend on many factors outside our control (offer, market, budget, platform changes, etc.). Services are provided “as is.”

11) Limit of liability

To the maximum extent allowed by law, our total liability for any claim related to these services is limited to the amount you paid us for the specific project that gave rise to the claim. We’re not liable for indirect, incidental, special, or consequential damages.

12) Third-party services

We’re not responsible for third-party platforms (payment processors, schedulers, AI tools, social networks). Your use of those services is governed by their terms and privacy policies.

13) Privacy

Your use of our sites and services is also governed by our Privacy Policy (linked here). We don’t sell your personal information.

14) DMCA / IP concerns

If you believe materials we host infringe your copyright, email info@pamelamarymusic.com with details, and we’ll review promptly.

15) Governing law & disputes

These Terms are governed by the laws of the State of Texas, USA (without regard to conflict rules).
Informal resolution first: You agree to email us about any dispute and allow 30 days to try to resolve it informally.
Arbitration: If unresolved, disputes will be settled by binding arbitration on an individual basis in Harris County, Texas, under AAA rules. No class actions. Judgment may be entered in any court with jurisdiction.

16) Changes to these Terms

We may update these Terms from time to time. The new date will appear at the top. Continued use after changes means you accept the updated Terms.
